This Acceptable Use Policy ("AUP") governs your use of AdsUp.Pro and is incorporated into the Terms of Service. Violations may result in immediate suspension or termination, retention and cooperation with platforms and authorities, refund forfeiture, and indemnification of any resulting harm to AdsUp Pro LLC.
1. Prohibited Content
You may not use the Service to create, store, generate, publish, distribute, advertise, or transmit content that:
- Is unlawful, defamatory, obscene, threatening, harassing, or invasive of privacy;
- Constitutes child sexual abuse material (CSAM) or sexualizes minors in any way;
- Promotes terrorism, violent extremism, or violence against any person or group;
- Promotes hatred or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or any other characteristic protected by applicable law;
- Infringes any intellectual property right, including copyright (text, images, music, video), trademark, trade dress, or patent;
- Misappropriates trade secrets or breaches confidentiality;
- Contains malware, viruses, ransomware, exploits, or links to such;
- Constitutes deepfake or synthetic media of an identifiable real person without their explicit prior written consent (subject to applicable right-of-publicity laws including the Tennessee ELVIS Act and New York Civil Rights §50);
- Uses unlicensed music, stock photography, video footage, or other third-party media in advertisements (TikTok's commercial-music library and other curated catalogs do not generally license use in paid advertisements; you are responsible for obtaining commercial sync licenses);
- Discloses personal data of any third party without a lawful basis or required consent.
2. Prohibited Advertising Practices
You may not run, schedule, or upload advertising campaigns that:
- Are deceptive, misleading, or fraudulent (false claims, fake reviews, fabricated endorsements, manipulated before/after images);
- Engage in click fraud, ad-spend inflation, fake engagement, bot traffic, or any other manipulation of advertising-platform systems;
- Discriminate in housing, employment, credit, insurance, or public-accommodation advertising in violation of the U.S. Fair Housing Act, Civil Rights Acts, ECOA, ADA, or equivalent EU equality directives, Australian Sex Discrimination Act, etc. (you may not use the Service to exclude protected categories from such advertising);
- Are political, election, issue, or government-affairs ads, unless you have first (a) completed the relevant platform's political-advertising authorization (Meta, Google, TikTok), (b) complied with all applicable disclosure laws (U.S. FEC, EU DSA Art. 26, UK Electoral Commission rules, etc.), and (c) obtained our prior written approval. Until such approval, political advertising via AdsUp is prohibited;
- Promote pharmaceuticals, prescription drugs, supplements with drug-like claims, controlled substances, cannabis, CBD, vaping, tobacco, alcohol, gambling, cryptocurrencies, ICOs, weapons, ammunition, sex services, or other regulated categories, unless you (a) hold all required licenses, (b) comply with the relevant platform policy, and (c) warrant compliance to us in writing in advance;
- Promote unlicensed financial services, investment opportunities, "get rich quick" schemes, predatory lending, or credit-repair services that violate applicable consumer-finance law;
- Promote healthcare services that make unsupported medical claims, MLM/pyramid schemes, or fake testimonials;
- Target children under 13 (or under 16 in the EEA) with behavioral advertising;
- Use sensitive personal data (health, sexual orientation, political views, etc.) for targeting in violation of applicable law and platform policy;
- Drive traffic to phishing sites, fake e-commerce, scam pages, or websites that misrepresent affiliation with AdsUp or any platform.
3. Prohibited Communications
You may not use the Service to send messages, DMs, comments, or other communications that:
- Constitute unsolicited commercial communications ("spam") in violation of CAN-SPAM (US), TCPA (US), GDPR Art. 21 / ePrivacy (EU), CASL (Canada), Australian Spam Act, or equivalent;
- Send commercial SMS, voice calls, or auto-dialed messages without prior express written consent of the recipient where required;
- Harass, dox, intimidate, or stalk any person;
- Impersonate any person or entity, or falsely represent affiliation;
- Solicit personal data, payment information, or credentials under false pretenses.
4. Prohibited Technical Conduct
- Attempting to gain unauthorized access to the Service, other customers' accounts, or supporting systems;
- Probing, scanning, or testing vulnerabilities of the Service except via our written-authorized vulnerability-disclosure process at security@adsup.pro;
- Interfering with the Service through denial-of-service, resource exhaustion, or excessive automation beyond rate limits;
- Reverse engineering, decompiling, disassembling, or attempting to derive source code, model weights, or system prompts;
- Scraping the Service or its outputs other than as part of normal product use;
- Using the Service or its outputs to train, fine-tune, distill, or develop a competing AI product or marketing-automation product;
- Submitting prompts that attempt to exfiltrate other tenants' data, override system instructions, or cause the AI to act outside its intended scope ("prompt injection");
- Configuring webhook callbacks pointing at internal addresses, localhost, link-local addresses (169.254.x.x), or other server-side request forgery (SSRF) targets. We may block such webhooks automatically;
- Sharing accounts among multiple unaffiliated users or selling/transferring credentials.
5. Sanctions, Export & Anti-Corruption
You may not use the Service in or for the benefit of any Restricted Jurisdiction or sanctioned person (see Section 1 of the Terms). You may not use the Service to violate U.S. Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), U.S. Foreign Corrupt Practices Act (FCPA), UK Bribery Act, OECD Anti-Bribery Convention, or equivalent laws.
6. Required Warranties on Customer Content
By submitting Customer Content for advertising, publication, or AI processing, you warrant that:
- You hold all necessary intellectual property rights, including model releases for any identifiable persons depicted, sync licenses for any music, and clearances for any third-party media;
- You comply with the policies of every platform on which the content is published (Meta Community Standards, Google Ads Policies, TikTok Community Guidelines, etc.);
- For ads in regulated industries (healthcare, financial services, alcohol, gambling, etc.) you hold all required licenses in every jurisdiction targeted, and the ad complies with applicable advertising substantiation requirements;
- For any user-generated content you republish, you have obtained all necessary licenses and consents;
- For any data you import (audiences, customer lists, lookalike seeds), you have collected the underlying personal data lawfully, have provided required notices, and have a lawful basis to use it for advertising;
- For any biometric data (face detection, voice, fingerprints), you have obtained explicit consent compliant with Illinois BIPA, Texas CUBI, Washington HB 1493, and equivalent laws.
7. Children's Data
You may not collect, target, or process personal data of children under 13 (under 16 in the EEA, where stricter) through the Service. If you discover that any data you have provided to us is of a child below the applicable threshold, you must notify us immediately at privacy@adsup.pro so we can delete it.
8. Enforcement
We may, in our sole discretion and without prior notice:
- Investigate suspected violations, including by reviewing logs and content (subject to the Privacy Policy);
- Remove or refuse to publish content;
- Limit, throttle, or rate-limit your account;
- Suspend or terminate your account, with or without refund;
- Cooperate with platforms (Meta, Google, TikTok, etc.), payment processors (Stripe, Xendit), banks, and law-enforcement agencies, including by disclosing relevant data and retaining audit logs;
- Pursue indemnification, recovery of fines, costs, and damages.
Material or repeated violations are grounds for permanent ban and may be reported to relevant authorities, platforms, and industry watchdogs.
9. Reporting
